| 0:40.9 | But we turn to two stories that came up often during the Biden administration and are part |

| 0:49.9 | One has to do with college admissions. |
| 0:52.7 | This is students for fair admissions versus Harvard, 2023, |
| 0:58.3 | linking to the University of California versus Bakke decision of 78. |
| 1:03.5 | How so, James? |
| 1:05.6 | Well, the Bakke decision, this was the first case that went before the Supreme Court |
| 1:10.1 | on the issue of so-called affirmative action in college admissions. |
| 1:14.1 | And the court was badly splintered on that case. |
| 1:16.5 | Four justices wanted to say that racial preferences to help minorities were just fine. |
| 1:22.3 | And four wanted to say that they were unacceptable. |
| 1:25.0 | And so Justice Lewis Powell ended up writing an opinion in which he spoke |
| 1:28.5 | only for himself. And he said that they are generally unacceptable, that they are acceptable |
| 1:34.6 | for the purposes of promoting diversity. And this was not a clear precedent of the court for 25 |
