Summary

Yesterday, at the Newseum in Washington, DC, FCC Chairman Ajit Pai outlined his vision for the future of Internet regulation, including a plan to undo "Title II." In 2015, Pai's predecessor, Tom Wheeler, reclassified broadband Internet as a "common carrier" service under Title II of the 1934 Communications Act. Net neutrality activists say that public utility regulations are necessary to have a free and open Internet. Critics of Title II, including Pai, argue that the rules are outdated and depress investment and innovation. Does the answer lie somewhere in between? What role might Congress and the Supreme Court play? Evan and Berin discuss all that and more with Chairman Pai.

the FCC under Chairman Tom Wheeler reclassified broadband

under Title II of the 1934 Communications Act. These are basically utility style rules designed

for railroads and telephone networks. Then the FCC said this was necessary to maintain

net neutrality and a free and open internet. But the current chairman

Ajit Pye says undoing Title II will actually hashtag free the net. You can go ahead and check

that on Twitter. So does undoing title two really mean the death of net neutrality? Or is this

0:47.5

exactly what broadband needs? Who better to explain this than the chairman himself? I'd love to welcome

to the show. Chairman Ajit Pye,

1:02.6

Baron, thank you for joining the show. Thanks. I was expecting it to be described as a third wheel again.

1:07.9

No, that was mean. I would never say that again.

1:24.3

So, Mr. Chairman, today there's an op-ed circling around the interwebs, as they are, by Senator Ron Wyden from Oregon, Senator Al Franken from Minnesota, and your predecessor, Tom Wheeler, a former FCC chairman.

1:29.0

And the headline says that you want to hand the internet over to big corporations.

1:31.5

I'll just give you a chance to defend yourself first.

1:34.9

Well, first, seven, thanks again for having me back on. The op-ed was an exercise in a hysterical overstatement and flat-out misinformation in a number of different ways.

1:43.9

For example, they mischaracterized exactly how the Internet has been regulated

1:47.5

and lived these many years.

1:48.9

We had light touch regulation from the dawn of the commercial Internet until 2015.
