Creative Apple. Hey everyone. It's me have here. I have breaking news on the Starker case, the case of Tanya

Fernandez and Rick Fernandez versus the state of Arizona. As you know, Tanya and Rick have both been charged with six felonies combined for aggravated harassment and computer tampering.

And this trial, this process leading up to the trial has taken a long time. In our last episode we heard

from Judge Suzanne Cohen who was presiding over the settlement conference of the

case. All rise. Thank you.

The judge explained that it is absolutely their right to go to trial and have the state proved

their case against them beyond a

reasonable doubt. But Judge Cohen explained the risks. She explained that if

they go to trial and they lose they could face up to two and a half years in

prison. So that's option number one going to trial. Option number two is to take the

deal that the prosecution has put forward.

If they take the deal, they're basically admitting guilt,

which Tanya Fernandez has made it clear that she is not willing to do.

I feel that if I under oath said that I did something that I didn't do, I'm lying.

And I know under oath you're supposed to tell the truth.

And I'm not going to lie under oath and

say I did something that I did not do. The judge told both Tanya and Rick that they

have a chance. It is a very triable case because at the end of the day we don't know for sure who was sending those messages.

The prosecutor jumped in and said, hey, we don't need to prove exactly who was sending the messages. they just have to prove that Tanya and Rick ate it in it.

In other words, they knew who was sending the messages and didn't stop them.
