of the National Review online and Thaddeus McCutter of American Greatness, my co-host, and we turned to the court cases that were

dominating the news earlier this year and at the end of 2023 about

former President Trump. They seem to have either

solved themselves or gone away momentarily because I see no sign of them with five

weeks, less than five weeks to go to the election.

And a very good evening to you, you have an editorial at the New York Post

and it reminds me that there's an enormous amount of money in at in question from the attorney general of New York,

Titia James against Donald Trump.

And yet, this enormous amount of money and the allegations and the convictions of Donald

Trump for business fraud did not please the appeals court. Who are the appeals court? What place does that play?

Well good evening John and that is the appeals court we're talking about here is

the appellate division first department which is the appellate division first department which is the intermediate level

appeals court in the state system so just so our listeners can I think people tend to know the federal system a little bit better than the state systems which can be eccentric in the federal system we have the trial court which is known as the district court then you have the circuit court which is known as the district court. Then you have the circuit court which is the

intermediate level of appeal and then you finally have the Supreme Court of the

United States which is the highest court and the top level of appeal.

In the New York system, the nomenclature is very confusing.

The trial court is known as the Supreme Court, whereas in almost every other state and in the federal system

the highest court is known as the Supreme Court. So here, the trial court's the Supreme Court.

The appellate division is the first level of appeal and then the

highest court is the New York State Court of Appeals.

So right now, Donald Trump's civil fraud case is before the appellate division first
