Guru versus Bolanger 2003 before the Supreme Court

regarded these many years later as a landmark case

to do with affirmative action in student admissions.

The result was a five to four success to maintain what was understood at the time

as affirmative action in the favor of diversity. Many years later,

these words are much admired and at the same time debated because the Supreme Court

in these last days on Halloween 2022 revisited much of the same story.

This time not about the University of Michigan or the University of

the University of California, but about the private institution of Harvard University

and the University of North Carolina. I welcome Professor Richard Epstein

of the Hoover Institution, writing most recently at defining ideas about the present case
