This is Handel on the Law Marginal Legal Advice, where I tell you, you have absolutely no case,

and it makes my day.

Okay, Orange County, California, which is the county right next to this county where I both live

and broadcast from L.A. County. This was a case in which a lawyer, who I will call pretty stupid, had just won a case,

a medical malpractice case. And then for some reason, he posts where he is bragging about the

win.

All right, fair enough.

I mean, lawyers tend to, and this was a good win, lawyers tend to brag about it.

He was a lawyer for the defendant and the plaintiff lost.

And then he goes and says, guy that was probably negligently killed, but we kind of make it look like other people did it.

In other words, he admit his guy was at fault, and he made it look like other people did it.

Effectively admitted that the jury was wrong.

And here's what judges have a right to do.

They have a right to set aside verdicts in civil cases.

A judgment notwithstanding verdicts, where the judge says the jury missed so much or the jury

didn't pay attention to so much that the evidence was simply not there or it was overwhelming and the jury was wrong.

And he went ahead and called it.

The judge issued a reversal of the verdict and says we start all over again.

New trial. And let me tell you how happy everybody was, especially the defendant.

Plaintiff was happy because plaintiff gets a new trial. So the new attorney representing the doctor who had won, but now has to go to trial again,

says Dr. Kwa'aishi, I guess doctor's name, vehemently disagrees with the court's decision

to grant a new trial.
