legal point, at least for his defense, who are trying to get it thrown out, saying that the

detective should have gotten a search warrant.

She, in fact, even says, would you give me permission to go into your phone, or should

I get a search warrant?

He goes, no, I'll give you a permission.

He gives a permission to go into his cell phone. Consent is a waiver of the Fourth Amendment rights. If you give

someone consent to search, that's good. The argument that the defense would make is that,

oh, the police in their very role as police are intimidating, and just the fact that they're asking should be viewed as an order. And that's the way the defense will probably go with this. But that will be all up to the judge. And I cannot see the judge throwing out the consent search of that phone, which led to the search warrant.

Because once the detective in this case found those bad photos on the phone, she obtained a search warrant to continue the

search. And that is what found the whatever was 15,000 images, 17,000 images that were downloaded
