It's a good question and I got a question about this recently for somebody as a matter of fact today

so I thought what a great opportunity to do a video and give you guys some answers to help you understand what you can and can't do in this situation.

Now, so really comes down to the fact is when you have a motor vehicle stop, we take a motor vehicle setting and

compelled to give you ID they don't have a violation they weren't wearing their seat

information and they don't want to give it to you or they give you a bullshit name and then you go back and you go to your computer and you try to figure out who they are and you can't figure out who they are the name they gave you doesn't seem to make sense you don't believe them and the answer is

somebody who was subject to a summons on title 39, you couldn't figure out who they are, you could make an arrest.

You can read that any time that somebody is subject to a Title 39 offense and we don't know who

they are. You can arrest a subject if you fear that they're going to fail to appear before a court in response to a summons.
