Summary

Jen Psaki breaks down what the Supreme Court said -- and didn't say -- in their ruling that states do not have the power to remove Donald Trump from the ballots under the 14th Amendment. Former NAACP Legal Defense Fund President Sherrilyn Ifill and lawyer George Conway react to the news of that decision and discuss the alarming ways in which SCOTUS has aided Trump in his legal battles. Amid new polling that spells trouble for the Biden campaign, Jen also addresses the choice that voters must make in November, despite whatever reservations they may have about the President. Newly elected Democratic Congressman Tom Suozzi of New York joins Jen in his first cable interview since being sworn-in. And in an interview with Jessica Mackler of EMILY'S List, Jen breaks the news that Mackler has officially become the group's new president.

Okay, I want to start tonight here in Washington, D.C., where for the second time in under one week, the Supreme Court weighed in on an issue related to Donald Trump.

0:18.1

Today, in a unanimous decision, the justices ruled that it is not up to states

0:22.8

to bar Trump from their ballots under the 14th Amendment. So he gets to stay on the ballot in Colorado,

0:28.3

where the primaries tomorrow, Maine and Illinois can't kick him off either. Now, this decision is

0:32.9

significant because the Supreme Court has never had to rule before on whether or not states

0:37.2

have the power to disqualify a candidate,

0:39.6

even an insurrectionist. But this outcome isn't necessarily surprising because the moment most legal experts heard the oral arguments,

0:47.3

and specifically the back and forth with the justices, most of them predicted the court would not take the step of barring the Republican frontrunner from the ballot, that they would find a way out, and they did.

0:58.1

Now, would a different outcome have sent a stronger message that you can't foment an

1:02.8

insurrection and be allowed to run for federal office?

1:05.6

Yes, it would have.

1:07.3

And would it be better for the prospects of President Biden's re-election if Donald Trump got kicked off the ballot, given the fact that he attempted to overturn the last election?

1:16.2

Yes. Obviously, the answer there is yes. But the Biden team was never banking on Trump getting booted.

1:22.0

I actually asked Biden's deputy campaign manager, Quentin, folks, about the ruling earlier today.

1:26.4

And this is what he said.

1:28.9

We don't really care because it's not been, it's not been the way that we've been planning to

1:33.3

beat Donald Trump. Our focus since day one of watching this campaign has been to defeat Donald

1:37.4

Trump at the ballot box. And everything we've done since the president announced back in April that

1:41.9

he was running for reelection is to build an infrastructure and apparatus to do so.

1:46.8

This is what they, like many of us, expected because of watching those oral arguments and

1:51.3

talking to a lot of smart legal experts.

1:53.0

But what wasn't expected today was that the majority of the court went further than simply
