It's good to be here although unfortunately under not the greatest of circumstances.

Yeah let's talk about those circumstances because when an entire draft opinion of a highly political court case gets leaked

and when that draft opinion says the Supreme Court wants to overturn Roe v. Wade you basically need to have a special emergency edition of this podcast.

If you have been living under a Supreme Court shaped rock you should know that on Monday night

Politico published the entire 98 page draft of a majority opinion written by Justice Samuel Alito that if ultimately issued by the court as a decision in the case

Dobbs versus Jackson Women's Health Organization would overturn Roe v. Wade fully overruled.

The leak is notable it's never we've never had a leak of an opinion before and with the high political stakes of the case it really is a holy shit situation.

So there is a lot to parse out here from the text of the draft itself. Why Justice Alito wrote it?

What this means for the expected decision in the Dobbs versus Jackson Women's Health Organization case and that's why we have Ian here to help us really get into the weeds of this news.

Ian what happened on Monday night and why is it such a big deal in your reading?

So first of all like as you said I think a leak like this is completely unprecedented. I mean I know of no example of an entire opinion leaking to the press before ever.

The Supreme Court has very strong norms of confidentiality. The justes have too much work to be able to do it without the help of their clerks and if they can't trust their clerks to keep the court secrets like that's going to be a big problem for the efficiency of the functioning of the court.
