Summary
Well, Nadhim Zahawi had a defence - that being forced to pay a huge penalty on his tax affairs was just a careless error. Slight hiccup: the head of HMRC has said that "innocent" mistakes aren't penalised. So where does that leave us? But there is a broader point - why we should talk about social harms rather than crimes, because our justice system is rigged in favour of the rich against the poor.

| 0:00.0 | Well, that's Toy Chair Nalim Zaharri's defence blown out of the water. After spending ages |
| 0:05.2 | saying, oh, my taxifers are all in order, it's fine, don't look at me, don't look at me, |
| 0:09.2 | nothing to see here if you keep digging, I'll sue you. That's the potted history of Nalim Zaharri |
| 0:14.1 | and tax. He had to fess up that he'd paid a penalty of 30%, applied to £3.7 million, just casually |
| 0:21.0 | lying around. That was expected to pay by his, his Majesty's revenue customs. Forgot, we've got |
| 0:28.3 | a king, haven't we, so only to get that correct. Don't want to be sent to London Tower, |
| 0:33.4 | along with Nalim Zaharri. Anyway, his argument was, it was a careless, careless, but deliberate error. |
| 0:41.1 | Unfortunately, that's been blown out of the water by Jim Harrah, a guy who should know, |
| 0:45.2 | because he's in charge of his Majesty's revenue and customs. Let's just hear what Jim Harrah |
| 0:51.0 | had to say. When I'll move over to Sarah only, MP. Thank you very much, Chair. Mr Harrah, I was just |
| 0:55.6 | wondering, what does it HMRC understand, or what does it mean to imply when it uses the word |
| 1:01.6 | carelessness that someone has been careless with their tax return, and what should the general |
| 1:06.2 | public understand by the use of that term? I mean, again, I'm not commenting on any particular |
| 1:12.5 | persons affairs, but carelessness is a concept in tax law. It can be relevant to how many |
| 1:19.0 | years, back years that we can assess, and it can be relevant to whether people, someone is liable |
| 1:23.9 | to a penalty, and if so, what penalty they would be liable to for an error in their tax affairs. |
| 1:31.1 | There are no penalties for innocent errors in your tax affairs. Yeah, you can sort of get the gist |
| 1:37.3 | there. Nalim Zaharri's defence is nonsense. You wouldn't have to pay a penalty for an innocent |
| 1:41.5 | error like that. Again, I think we need to just be very clear. Again, I keep saying there's |
| 1:46.1 | tax avoidance, tax evasion, not the same thing. Can't see me for this, Nadim, to say, don't say |
| 1:50.1 | me illegal, like you said, the independent and various other people. Basically, no one's |
| 1:56.8 | accusing them of doing something illegal. It's the issue of legal tax avoidance where the |
