0:05.3	Now how is that happening? How is it that he's called to the stand twice?
0:09.3	So let's talk about that and talk about how this works and why he will have testified a couple of times.
0:16.5	The answer is because this is a civil case, not a criminal case, which is very different
0:22.1	in terms of the rules of who you can call as a witness in your case or not.
0:27.0	And although he's a defendant, the attorney general is allowed to depose him, as well as his father, his brother, his sister, etc.

0:36.8	You take depositions in civil cases in New York, not in criminal cases.
0:41.8	So they've already been deposed and you're allowed to call them in your case in chief so you
0:46.0	which means they're going to be hostile witnesses because they're defendants but you can cross

0:54.6	Now, the person can take the fifth if they want,
0:57.1	but then because again, it's a civil case.
0:59.2	The judge can, it's called an adverse inference against you.
1:03.6	They can find that, look, that I'm going to infer the worst.
1:08.1	I'm going to infer that you would have said something negative
1:10.7	had you testified if you take the fifth.
1:12.8	So it's just totally different and a little bit bonkers for me
1:16.2	who came up in the criminal world that you can do that.
1:19.9	And this is a judge trial, not a jury trial.
1:22.6	So the judge here, Judge Arthur and Goron,
1:25.7	is the finder of fact, and he's also the person
