games. Now look I have spoken about the media's impact on high profile cases throughout this long journey on several occasions.

Yet I'm going to go to that well one more time, at least,

because the media's impact on the Garcia case was so profound that it bears repeating repeatedly. It's not just that the media was biased in its reporting on the case, as that happens with nearly every

high-profile case and it's tough to blame the media generally speaking because

it has been the rule since the beginning of our country that the state's narrative in theory

is typically the only source that the media has to draw information from

about the facts and the evidence in the case. Therefore, that is what they report on.

But that's not what was going on in the Garcia case. Now what was happening there is that the Omaha World Herald was being leaked

evidence about the case who was doing the leaking well I can only speculate as

to that but it could only be one of a few sources.

And frankly, who it was matters not.

It's the fact that it was happening at all that I had a problem with.

Here's a good example.

Somehow, a reporter from the World Herald was invited into the judges chambers for an off-the-record hearing which we happened to be

appearing telephonically for. Now we were unaware that the press was back in

chambers with the judge and the state during the hearing.
