event occurred just a couple of months earlier in the state of Nebraska that directly and profoundly impacted Anthony Garcia's case,

which was that the death penalty was repealed. Now this was very significant for

many reasons, one of which is that very early on the case,

as the Douglas County Attorney's Office was prone to do, made a life without the possibility

of parole offer to Garcia, which Garcia rejected.

Now it is not unusual for prosecutors to use the threat of the death penalty in plea

negotiations in order to secure convictions, which raises many issues that are far too in

depth to get into here. But the fact is that states that have the death penalty

as an option find it to be a very useful tool

in avoiding litigation and securing convictions.

Now the fact that the death penalty was repealed did not affect the nuts and bolts of the trial itself

meaning that the litigation in the case would proceed as planned with all the necessary issues being litigated before the matter was brought to trial.

But as far as the mindset of every attorney on the defense team, the fact that the death penalty

had been repealed, well, that lifted a massive load off of our collective

minds.

I can't say this definitively as I have not worked every high-pressure job that exists, but from the perspective of having tried a death
