You're going to be. The September trial date is looming as in a few short months we are

scheduled to be picking a jury for this massive case.

We continue to have real difficulties communicating with Anthony Garcia, as the conditions of

his pretrial incarceration are truly affecting his mental health, which has presented us with the real challenge

as we have been rebuffed by the court on numerous occasions in our efforts to have Garcia moved out of administrative segregation,

where he has been held in solitary for 23 hours a day,

going on two years.

And it doesn't appear that the situation is going to change anytime soon as the

conditions of his incarceration continue to remain the same.

While all of this is going on with Garcia,

Alice and my father and I continually discuss

if we must once again challenge Garcia's competency to stand trial, despite the fact that we had just

challenged his competency only a few months earlier and that the doctor at that point

determined Garcia was fit to stand trial.

Despite what a doctor at a state facility may have determined,

the reality of Garcia's ability to assist in his own defense has been severely compromised.

In the meantime, the state continues to suggest that Garcia's malingering, which is a fascinating

concept considering that no one connected with the state has

ever spoken a word with Anthony Garcia at any point in time.

So beyond a single page report from a state-run mental facility and Kites, written by Garcia himself

complaining of being tortured, it's amazing to me when pondering of just how exactly the state would have any clue as to our

client's mental state.
