Do they just bring it to trial and hope that the judge allows it in?

Or is there an agreement by the party? bring it to trial and hope that the judge allows it in?

Or is there an agreement by the parties?

Or do they just let it all in and let the chips fall where they may?

It's my favorite time.

It's the pretrial motion phase of any cases

were the war is fought time. So if you're a long time,

then you will know that I have always said

that the nuts and bolts of any criminal or civil case for that matter is during the

pretrial motion phase and if you're a new listener well now you know when we are

watching a trial that is the culmination of many, many months, often years,

getting the case ready to be presented to a jury at trial.

As both sides have litigated many issues in that time and have fought to keep things out of

evidence for a myriad of reasons and they've also battled to have things introduced into

evidence at trial.

It is during this time frame that the judge on the case

performs one if not the most important role

that she or he is charged with, which is to be the gatekeeper of the evidence.
