Summary

The White House has been boasting that President Trump’s partial pause in the trade war with China is a historic breakthrough. But two new reports, one from The New York Times and the other from the non-liberal Wall Street Journal editorial page, neatly expose what a monstrous scam this notion truly is, in and of itself. As they detail, Trump has put the global economy through major turmoil and uncertainty, but without winning any serious concessions from China. This will get worse for Trump: In addition to being terrible policy, the tariffs are a massive abuse of power. And once the lawsuits against them get going, this, too, will be fully aired out. We spoke to George Mason University law professor Ilya Somin, who’s helping spearhead one of the most important legal challenges. He explains why the tariffs are on weak legal ground, what the prospects are for reversing them, and how they reflect a much deeper lawlessness on Trump’s part. Looking for More from the DSR Network? President Donald Trump's trade war with China is coming under increasing media scrutiny,

0:32.9

and the results are brutal.

0:39.4

A new editorial from the Wall Street Journal savagely notes that Trump's recent climb down with China was a surrender that has only produced more economic uncertainty.

0:44.1

A long New York Times piece details that Trump's aggression has not produced any major concessions from China.

We think this is going to get worse, and here's why. In addition to being terrible

policy, the tariffs are a massive abuse of power, and once the lawsuits against them get going,

1:02.6

this, too, will be fully aired out for the public. Ilya Soman, a law professor at George

Mason University, is helping to spear

had one of the most important lawsuits against these tariffs, a suit brought by five businesses.

1:16.3

So we invited Ilya on the show to talk about where this is all going.

1:20.1

Ilya, thanks for coming on.

1:21.7

Thank you very much for having me.

1:23.6

So this new Wall Street Journal editorial is very harsh.

1:26.9

It notes that Trump just reduced his tariffs on China to 30% as part of this pause. Critically, though, the journal describes this as a major retreat and a surrender and a repudiation of Trump's underlying policy ideas here. I take it you agree with all that, I'll you?

1:43.9

To a large extent,

1:45.7

though I would note it's not a complete repudiation of his underlying policy ideas given there's still

1:51.1

a 30% tariff on China, which is still much higher than before he started this trade war. So it's in

1:58.3

accordance with his philosophy. The tariffs are somehow good for us. But in

2:01.7

reality, they cause enormous harm. So it would be better if you really did just repudiate that

2:06.3

philosophy because it's a bad one. Indeed, it is. But this is a retreat and a surrender. Can you
