Our Constitution has survived and endured for more than 200 years longer than any

Constitution in the history of humankind. And yet today in an effort to end the presidency of Donald Trump a few

days before the Constitution ends his presidency the First Amendment, will distort the First Amendment, will distort the First Amendment,

will distort the criteria for impeachment,

and will do grave future damage

to provision. grave future damage to provisions of our Constitution that not only protect sitting

presidents but all Americans who engage in the freedom of speech which is the loadstone of our democracy.

We will see a president of the United States impeached today by an overwhelming vote, including

probably every Democrat, maybe one or two exceptions and several Republicans all of whom are thinking

short term about partisan political advantage they can reap from this

ill-conceived vote without thinking through the implications not only for future presidents but for the great and important freedom of speech in the United States.

The idea of impeaching a president for a speech that is well within the

protection of our Constitution, that is well within the principles of

Brandenburg versus Ohio which is the leading case unanimously decided by a

relatively moderate Supreme Court will so undercut values that I have fought for for more
