Summary

President Trump suffered a major loss Tuesday when a federal judge in California ruled that his military occupation of Los Angeles was illegal. Trump’s response was highly unsettling. Speaking to reporters, he sounded entirely unconstrained. He threatened to resend the military to L.A. and declared that the military is now definitely going into Chicago. He let out a strange, angry rant about crime in DC that sounded frankly pretty nuts, worrying a variety of legal observers. And he abruptly ended the presser amid another display of anger. We talked to former federal prosecutor Barbara McQuade, who explains the nuts-and-bolts of the judge’s L.A. ruling and looks ahead to the possibility of a major inter-branch confrontation with Trump if the courts continue to block his military occupations. McQuade explains why all these displays from Trump show that we’re in “a combustible situation waiting for something very bad to happen.”  Looking for More from the DSR Network? a major confrontation if the courts continue to try to block his military occupations. But we think

1:10.0

it would be particularly combustible if he

1:12.3

stages this confrontation on this particular issue. We're talking about all this with former

federal prosecutor Barbara McQuaid, who's going to help us understand where it might all be headed.

1:23.3

Barbara, always good to see you. Thanks, Greg. Glad to be with you.

1:27.4

So federal district judge Charles Breyer and San Francisco issued this ruling, and it was really unsparing.

1:33.7

He found that Trump's unleashing of the National Guard and Marines violated the Pasi Comitatis Act.

1:39.8

Breyer wrote that this has created, quote, a national police force with the president as its chief.

1:46.5

Alarming stuff.

1:47.8

The ruling only applies to California and it's on hold for 10 days while Trump presumably appeals.

1:53.3

Barb, what jumped out at you about the ruling?

1:56.1

Well, it was interesting because you may recall that Judge Breyer initially did block the initiation

2:03.2

of troops into Los Angeles, finding that there was an insatisfactory finding of an emergency.
