being tried for a non-crime.

Nobody can figure out.

Apparently he quoted me today saying that there is no crime.

He doesn't have to quote me.

Any reasonable legal scholar who doesn't work for CNN or MSNBC

would acknowledge there's just no crime.

That doesn't mean it won't be a conviction.

In Alice in Wendelland, you get a conviction without a crime,

and that's what may very well happen here although you know there's a possibility

obviously of a hun jury or even conceivably of an acquittal.

What should happen of course is the judge should dismiss the case

at the close of the prosecution's presentation

because he will have heard no evidence of any crime whatsoever

being committed.

So, but he's not going to do that.

And so what we're seeing is a trial within a trial.
