Summary

...is paved with good intentions. The issue in this case -- which was up in the air at the time of recording and now isn't (we lost) -- was a specific one: namely, should Republicans use a fifty-one percent majority vote in a state election to amend the state's constitution so that it required a SIXTY percent vote to amend it in the future? The larger issue is, of course, should you use the unscrupulous tactics of your enemy in order to block them from using those unscrupulous tactics in the future? Have Republicans once again found the wrong way to do the right thing?

I'm Scott Ott with Stephen Green and Bill Whittle, and this episode of Right Angle is brought to you by the members at Bill Whittle.

Gentlemen, by the time folks see this video, which we're recording on Tuesday, the 8th of August, it will be decided in Ohio.

0:18.0

That is, the ballot referendum on issue number one, which would amend the state

0:23.4

constitution to increase the vote count needed to amend the state constitution, essentially.

0:31.0

Right now, you can amend the Ohio state constitution with a referendum on a ballot that registers 50% of the electorate plus one.

0:41.7

So that's just a bare majority.

0:43.9

The referendum in issue one would do, among other things, bump that percentage up to 60%.

0:50.2

So make it close to a super majority percentage.

0:53.0

It would do a couple of other things, too, just to get an initiative on the ballot. Instead of requiring signatures from 5% of the electorate in 44 of Ohio's 88 counties, it would require 5% of the electorate's signatures in 88 of Ohio's 88 counties so that you would have a broad representation across the state.

Now, this is, as many in the media have characterized it, essentially a proxy battle over abortion,

1:19.4

because in November, a ballot initiative will appear that will effectively legalize abortion

1:26.2

or increase what they call abortion rights in the state of

1:29.3

Ohio. And this is a Republican effort to get out ahead of that to make it so that for that to

1:35.2

pass in November, the abortion rights issue to pass in November as part of the state constitution

1:39.7

will, it will require a 60% almost super majority in that. I don't want to get into the details,

1:47.9

obviously, of what happened, because at this point in the time warp, I don't know what happened

1:52.8

yet. However, Stephen Green, it occurs to me that this is a bad way to handle a Constitution in general.

2:02.6

And by that I mean two things.

2:04.6

Number one, it's a bad way to make a constitution,

2:07.6

if you make the Constitution amendable on a 50% plus one vote,

2:13.6

that's a bad idea.
