Her is not going to charge Biden criminally in the case, but said part of the reason is he's elderly with a poor memory, and he couldn't

remember a lot of basic facts about his own life, like what year he became vice president,

what year his first son died. He has a poor memory, said the special counsel, and the LA, the New York Times has four stories on that.

It looks to be a straightforward account.

This story has been out for several hours.

They have nothing on it.

But they have stories about Trump's case of the Supreme Court.

We will talk about that now with ABC News correspondent Stephen Portnoy.

Today, the case before the Supreme Court was Colorado taking Trump off the ballot,

claiming under the U.S. Constitution's 14th Amendment, it disallows people involved in insurrection from being an office, including the presidency.

Trump obviously disagreed with that, and we've had a lawsuit, and the Supreme Court heard the arguments, the oral arguments.

We're going to talk to Stephen Portnoy because it seemed that most of the Supreme Court justices didn't like the idea of keeping Trump off the ballot.
