Content warning, this episode contains discussion about the murder of two girls, and I just want to stress that this episode will contain a lot of disturbing details about the crime scene in the Delphi murders case.

0:14.0

So once we get to that point, we will let you know and just proceed with caution.

0:21.0

So we're recording this on Monday, September 18th. Earlier this morning, the defense made several filings.

0:31.0

The one we're going to focus on in this episode is 136 page memorandum in support of their request for a Frank's hearing.

0:43.0

Again, a Frank's hearing is when the defense says the search warrant or what have you in the case should be thrown out because the investigative officers fail to disclose certain details or lied about certain things when they requested the search warrant.

1:03.0

So this is a memorandum supporting their arguments for why the search warrant in this case should be thrown out.

1:12.0

It's a lengthy document, as I say, and it's quite detailed. It kind of falls into a few separate categories.

1:23.0

The first category would be in our mind, their contention as this murder was actually a ritualistic murder carried out by members of a pagan Norse religion called Odinism.

1:40.0

And they feel that these Odinists also, for instance, they cite that in addition to the fact that the killing was carried out by Odinists, that that angle was not sufficiently investigated.

1:54.0

And they also say that some of the prison guards at Westville are associated with Odinism. And of course Westville is where Richard Allen is housed.

2:06.0

There's an odinistic conspiracy at the heart of their theory of the crime, it seems like, is fair to say.

2:12.0

That's fair to say. Also, this document goes into considerable detail about the crime scene.

2:22.0

And the reason they do that is because it's been suggested that not only is misjusted by the prosecution, the not only is Richard Allen guilty, but perhaps he acted alone.

2:37.0

And so the defense wants to make the case. Here's what the crime scene was like. Here's all the things Richard Allen or any loan actor would have had to do by themselves.

2:49.0

If they were acting alone, we don't think one person could have done all these things. So that's one reason why they go into the crime scene details.

2:57.0

And another reason why they do so is because they want to stress what they feel are things at the crime scene, which are somehow linked to Odinism.

3:09.0

The third point they go to into in this document is the PCA itself.

3:18.0

This is the PCA that was released explaining the case, the prosecution made for why they believe Richard Allen was guilty, why they believe his house should have been searched and so on.

3:31.0

The defense talks about some of the details cited in that document is coming from witnesses and it argues that those details were not cited accurately.

3:47.0

Before we go into all of this, we should note these are serious allegations, but we're going to be sharing the defense's point of view on these.

4:01.0

We hope that the prosecution makes a public response to some of these as soon as possible, so we can share that with you as well.

4:10.0

And then hopefully once we have both sides out there, it will be possible to try to determine the truth of these matters.
