So last week, of course, we talked a lot about what actually happened in the courtroom on Thursday in the hearing involving the Richard Allen case.

We did not go into much detail on the other hand about what didn't happen. It was supposed to be, as we all know, a suppression hearing.

So why exactly did that suppression hearing get delayed? And what could that potentially tell us about the future of this case and where things might be headed?

So when the judge said that the suppression hearing was going to be delayed, she did offer a bit of an explanation.

She said it was because of Frank's V Delaware issues, basically.

What is Frank's V Delaware?

Frank's V Delaware is a Supreme Court case from back in the late 70s.

And basically it's kind of a complicated case, but the gist of it is that if the law enforcement officers who put together a search warrant include in their statements that they know or strongly suspect or false in order to get the warrant, then you need to throw those false statements out.

And if after you throw out those false statements, there's not enough left to justify the problem caused for the search warrant, then the search warrant itself must be thrown out and that any evidence seized as a result of that search warrant must also be suppressed.

Okay, so can I use a dumb anecdote here or dumb metaphor perhaps? So is that like if if we're Apple farmers, you know, I love Macintosh apples, we get a whole crop of apples.

But then through some science, we learn that a bunch of the apples have worms in them, but we are supposed to deliver a metric ton of apples.

You know, after we throw out all the wormy apples, it's kind of like if we still have a metric ton, we're good. We're still in business.

If we have to throw out the wormy apples, then we are going to lose the farm and go bankrupt.
