This week Judge Brett Kavanaugh This week Judge Brett Kavanaugh was confirmed as a Supreme Court justice.

In the wake of that defeat, Democrats have begun to debate and dissect how that defeat

could have been prevented.

As Republicans adopt aggressive tactics and shatter well-established norms in the age of

Trump, should Democrats change their tactics to fight fire with fire? Should they do so even if it violates norms that should be respected?

In particular, should the Democrats have been more aggressive in attacking the limited FBI investigation of Kavanaugh,

I'm a former federal prosecutor,

a practicing lawyer, and a CNN legal analyst.

And I'm joined by my friend Patty Vasquez,

a comedian and WGM radio host who joins us regularly on this podcast.

So, Patty, this week, obviously we had huge news, the confirmation of Judge Kavanaugh to the Supreme Court

a lot of very upset people on the Democratic side of the aisle and I think a lot of

finger pointing people blaming one person or another there's been

some people for example blaming Michael Avinotti for the client that he brought forward

there's been people who have blamed Democrats

in the Judiciary Committee for not being aggressive enough.

I will tell you my initial reaction to it is that it's

a lot easier to win when you have more votes and so as a

price yeah I think someone got more votes and still lost somehow years
