If you've been following the case against Brian Koberger, you know this isn't just another murder trial.

It is a capital murder trial.

Four young victims, a country watching, and a defendant who's pleaded not guilty.

And now with just a few months left before the scheduled start of his trial in August, the defense has thrown up a massive legal flare.

On May 20th, Coburgers, attorneys filed a motion seeking and asking the court to hit pause.

They want more time, a lot more.

And depending on who you ask, it's either a desperate attempt to

stall the inevitable or a constitutionally necessary move to prevent a ticking time bomb

of legal disaster. And let's be clear about what this motion actually is. It's not just a polite request for a scheduling tweak.

It's a warning shot.

The defense is saying, if you make us go to trial in August, it won't just be unfair.

It will be unconstitutional.

They're arguing that this timeline violates Koeberger's Sixth Amendment right to

effective counsel.

His Eighth Amendment rights to a fair and reliable sentencing.

And his 14th Amendment due process protections.

That's not a legal window dressing.

That's the core of the American justice system being put on the table.
