Today's episode is going to deal with a kind of a promise, more like a prediction I made about the Supreme Court.

Three years ago, when the Supreme Court overturned Roe versus Wade, it did so on the basis of a legal theory called substantive due

process, the whackness of substantive due process. That's not exactly the way

that Justice Thomas put it. But the court documents, the whackness. Yeah, substantive due process,

equal protection clause, two clauses in the 14th Amendment are both whack. In the whole 14th

amendment is basically whack.

That's not quite what he said.

But in that case, Dobbs versus Jackson, women's health, when they overturned Row,

Justice Thomas said, we are coming for more of the substantive due process cases.

Those are the cases that where it's a legislative moral power of the state, a police power of the state,

that's supposed to be left to the 50 several states like Roe versus Wade,

except, like abortion, except it was commandeered by the national government.

It made it illegal for red states to illegalize abortion.

Well, the same thing happened in Obergefell v. Hodges.

That is the case under Obama that made it illegal for individual

red states to illegalize gay marriage. Illegal to illegalize. They put a ban on banning.

They also did this with pran or pornea in a case called, not map.
