Hello and welcome. I am John Cryer and this is the Undisclosed Addendum. In the most

0:26.1

recent episode of the State vs. Willie V.C., we explored the state's star witness recantation of her

0:31.6

testimony and whether it will or will not have an effect on the case. And with me today is one of

0:36.7

the hosts of Undisclosed. She's also a blogger at the view from LL2 and the host of the 45th podcast,

0:42.7

Ladies and Gentlemen, Susan Simpson. This is the first time I simulated a studio audience. I'm

0:51.2

going to be doing this all through the podcast this week. I hope that doesn't throw you off.

0:55.1

Also with us are Jim Fagorski and Marissa Bluestine. Jim was a Philadelphia police officer for

1:01.5

25 years from 1981 until 2006, retiring as a lieutenant. After he got his law degree in 2009,

1:08.7

Jim volunteered to assist the Pennsylvania Innocence Project to evaluate cases for merit and

1:12.9

has since worked with both Sean Thomas and Willie V.C. Marissa Bluestine has been with the

1:17.3

Pennsylvania Innocence Project since its inception in April 2009, beginning as the project's legal

1:22.4

director. Marissa was made executive director in 2017. Welcome back to the show guys. Thank you.

1:27.2

I just got to have a look. So glad. So glad. Now you guys, we got to start with the new evidence.

1:32.9

That's obviously very exciting. But what does it mean and why would it be put under seal?

1:38.9

It's under seal because the DA is also subjected basically because the Marissa Bluestine actually

1:46.0

found the evidence and she provided it to the people who were representing

1:50.7

only V.C. and one other person and they're basically what we consider to be Brady violations that we

1:56.0

can't discuss. And the DA is also subjected to finding these the way that we did, which is the

2:03.1

result of a federal civil suit. And they don't believe that these should be used in state court and

2:08.7

they're trying to prevent us from doing so by filing under seal and calling them confidential.

2:13.7

So we're waiting for the judges ruling on whether these items are fact confidential and we can't

2:18.6

discuss them until that happens. Can you explain their logic there a bit more? I don't even understand
