So we got some news yesterday about a case that is going up to Scotis. Do you want to tee it up?

Sure. So I guess as a starting point, what I'll say is that as you may or may not be aware,

a lot of the things that the government does are not done by Congress, which let's face it, doesn't pass nearly as many laws as we would

like it to pass.

They just are often involved in gridlock or making speeches for Fox News or something

along those lines.

And they're not done directly by the president, who's one person after all,

but by a very significant regulatory state, right?

So many of the things that the government does that we care about,

whether it's the FAA regulating aircraft, making sure our aircraft are going to get there at time,

or the FDA, you know, making sure that our food and drugs are safe or or the SEC policing

the financial markets all of these things are done by regulatory bodies that were not really contemplated when the

Constitution was first written.

That state, I think, was empowered by a decision that you and I learned in law school,
