0:15.2	A short time ago, the administration signaling it will fight that court ruling that struck
0:19.5	down the mask mandate for mass transportation.
0:21.9	Jeremy Diamond is at the White House with the latest.
0:23.9	So what are they saying?
0:24.9	Well, Anderson, just two days ago, that federal judge struck down that mask mandate, and
0:29.4	tonight we're learning that the Justice Department is indeed moving forward with an appeal.
0:33.5	This is a statement from the CDC.
0:35.0	They say, quote, to protect CDC's public health authority beyond the ongoing assessment
0:40.0	announced last week.
0:41.3	CDC has asked DOJ to proceed with an appeal.
0:44.1	It is CDC's continuing assessment that at this time an order requiring masking in the indoor
0:48.9	transportation corridor remains necessary for the public health.
0:52.6	And what's interesting in that statement, Anderson, is the CDC is indicating that their
0:56.4	rationale for moving forward with an appeal is twofold.
0:59.2	On the one hand, the conditions right now require that mask mandate across the country.
1:04.1	And on the second hand, they want to maintain that legal authority.
