Rob, that's a great question.

It's uncommon, but it does happen.

It's even happened to me.

Generally, where it's happened to me is in a similar circumstance, where we're trying to say, hey,

somebody else did it, they didn't investigate it correctly, there's a reasonable doubt, etc.

So it's not, it's not very common, but it does happen and it's one of the judges duties is to make sure that there's an adequate they would use the word probably nexus or connection to the evidence that suggests that this does is somewhat
