But before we get into the re-release, I wanted to talk about what the presidential pardon power

is, because it kind of seems like just a little magic wand that the president has to let

criminals run free. To an extent, it is a little magic wand that the president

gets. And it is a power that is given to the president through Article 2, Section 2,

Clause 1 of the Constitution. And it says the president shall have power to grant reprieves

and pardons for offenses against the United States, except

in cases of impeachment. According to the Supreme Court, the pardon power is intended as a tool

for justice and mercy. As one federal court has held, the president who exercises that power as the

elected representative of all the people must always exercise it in the

public interest. While the presidential pardon power is expansive, it is not limitless. The pardon clause

makes explicit that pardons may only extend to quote offenses against the United States,

meaning state criminal offenses and civil liability aren't pardonable.
