Robert Herr for his own mishandling of classified documents during his time as Vice President.

Now we've covered this extensively but for those who would like nothing more than to

equate Donald Trump and Joe Biden the issue wasn't so much that they both

retain classified documents as it was

Trump's unwillingness to give those documents back. Remember Trump was asked by the

National Archives and refused, then he was subpoenaed and he refused and

finally a federal magistrate approved a search warrant which led to that

Biden on the other hand just complied.

But still in fairness, Merrick Erland named Robert Herr as a special prosecutor to investigate Joe Biden

and to determine whether to press charges.

This week, Her opted not to charge Biden, stating that there wouldn't be enough evidence

to convict him in front of a jury, but not before also adding that Joe Biden presented as a quote elderly old man with a poor memory.
