| 0:13.2 | the hearing was to argue removing the gag order. So let's break down what happened. The state had |

| 0:21.5 | objecting to that, but the defense did file an objection stating they do have continuing objections |
| 0:27.9 | to lifting the gag order. The media attorney Wendy Olson said that they understand the |
| 0:33.6 | defense's concern about the media coverage surrounding Brian, but they did not think continuing |
| 0:39.5 | the gag order helps that at all. It limits the media from reaching out to those who know the most |
| 0:45.2 | about the case, but that doesn't mean anybody's obligated to say anything. She goes on to say the |
| 0:51.0 | defense also raised due process concerns related to sentencing, |
| 0:55.0 | but they don't think any of those arguments raised by the defense should outweigh the First Amendment rights of their clients, being the media. |
| 1:03.7 | Mr. Barlow made arguments for the defense, and he said the publicity is extensive and emotions are already so high, that adding fuel to the fire |

| 1:24.2 | sentence attached to it, as the court knows, things can happen at sentencing hearings, |
| 1:30.4 | and to minimize that possibility, they asked the order stay in place. The judge said at the time |
| 1:36.3 | Coburger pleaded guilty the court was ready to lift the order. The main purpose of the order |
| 1:41.9 | being put in place was to ensure they would be able to seat an impartial jury, and that is not in play now. |
| 1:49.6 | He understands the concerns of the defense, but he doesn't think that that outweighs the rights of the public to information. |
| 1:56.9 | He said not lifting, the order isn't going to lessen the media attention. |
| 2:01.3 | It's like water, finding low ground. It will flow regardless. |
| 2:05.5 | Also, lifting the order doesn't require anyone previously bound by it to speak. |
