As our guest today argues, liberals have contributed to conservative success by imagining constitutional law as an

autonomous domain separate from politics.

Liberals have likewise imagined that most questions about how to regulate the

economy are separate from politics, best left to technocrats.

See what I was saying? But that's not how conservatives or those on the right have ever

reimagined the Supreme Court. They have always viewed the judicial branch as a place

where in fact politics do happen and have a major contributing impact. Again quoting

today's guest, the liberals of the late 20th century believed that many

economic questions were best left to technocratic experts. This is a mistake in one measure

of its magnitude is the extent to which since the 1970s the US economy

has become increasingly monopolistic and with most sectors dominated by a

small number of firms. As we will see it's almost as if liberals abdicated what power they had and ceded the law of the land to conservatives who then moved forward with their hopes at centralizing the power of corporations and instituting not only

oligopolies, but a path toward monopolies and oligarchy.

This abdication of power also led to empowering those who oppose racial inclusion.
