Everybody is trying to get pardons and commutations. Today is the last full day of the presidency of Donald Trump.

He will grant pardons.

Does he have the power to do so?

Today is the last full day of President Trump's term as President of the United States.

Tomorrow he becomes Citizen Trump and it's expected that today he will exercise one of the few powers

that the president can exercise alone without the consent of Congress,

without the advice of the Justice Department, the President under

the Constitution, and I'll quote, shall have the power to grant reprieves and pardons for

offenses against the United States except in cases of impeachment.

In other words, the president cannot pardon himself or anyone else who is being impeached, but he can pardon anyone, presumably, including himself,

from any offenses against the United States,

whether offenses that have already been prosecuted or offenses that are to be prosecuted

in the future, it has to be offenses that have been committed.

You can't pardon somebody for future crimes, although Jefferson came awfully

close to trying to do that during the Aaron Burr trial.

He called potential witnesses into his office and made them a deal, the President

of the United States, sitting and making a deal.

If you will testify against Aaron Burr, I will give you a pardon which is basically a form of immunity, but if you don't

testify against him, we will prosecute you, not Jefferson's finest hour. Jefferson was obsessed with the need to prosecute and convict
