Summary

The co-founder of Palestine Action has won a legal challenge to the home secretary’s decision to ban the group under anti-terrorism laws. Palestine Action was the first direct action protest group to be proscribed. The decision was widely condemned and was defied by a civil disobedience campaign, during which more than 2,000 people have been arrested. From July last year, being a member of – or showing support for – the group became an offence punishable by up to 14 years in prison. Lucy Hough speaks to Guardian columnist Owen Jones - watch on YouTube. Help support our independent journalism at theguardian.com/infocus

individuals, which are clearly not terrorists, a red line has been crossed. That is a red line

where you cross into some degree of authoritarianism. Judges at the High Court have ruled that the government's prescription of Palestine action as a terror group is unlawful.

Palestine action, which was prescribed by the government in the summer of last year in July, putting it in the same group as ISIS, Al-Qaeda, various neo-Nazi groups. That has

1:29.9

been ruled unlawful in the High Court. We'll come on to the detail because it's not clear

1:35.5

cut, is it? The government are still saying effectively the ban remains in place and that they plan

to appeal. But nonetheless, this is a huge legal victory for Hudaa Ramiore and the other activists involved in this case.

1:46.7

Yeah, a historic victory. And I think what's so striking about it is, I mean, in the judgment it says they engage in criminal activity for which normal criminal law exists.

1:57.2

You know, if you engage in property damage, you do expect to get arrested.

The question of what is unlawful, of course, which is what Shabana Mahmoud has said about
