And Judge Mershaw did not buy, I guess what, the Supreme Court's argument

So it's something that the government, the prosecutors, would have to prove with a pretty high bar

case is not that Judge Mershahn has,

I think, left no room for him to dismiss this case. He still has one more opportunity

to do that before more appeals begin. But at the same time, this was a way for him to say,

you know what, I'm bound by the U.S. Supreme Court. You guys tried to do this with these federal charges. This is, there's immunity

questions, there's privileged questions. This doesn't work anymore. That's right. And this decision

was expected early November, around November 12th. However, Judge Mershahn postponed releasing this decision on how

the Supreme Court's immunity decision would affect his sentencing in the case.

And that's why there's no sentencing yet because there's more cases to come from Mershan.
