Rankquest was appointed on the eve of the Court's post-warren era shift to the right.

In the 1970s and early 80s, Rankquest repeatedly failed to persuade

often anyone else on the court that state sovereignty could trump federal congressional power.

But by the 1990s, he had a 5 Justice majority that was striking down federal laws right and left
