Before we get to this week's note itself, I just want to circle back to

something we touched on quickly last week, and that's the plea deals for Khalid Sheikh Mohammed,

KSM, the 9-11 conspirator, and two other defendants in military court. At the time we recorded

this last week, news had come out that military prosecutors, not DOJ, not your

civilian prosecutors, but military prosecutors had reached a deal where KSM would be given a life

sentence, but they would not seek the death penalty on him. I said in last week's recording

that there would be pushback and resistance and rejection from the families of victims. Sure enough,

that happened. I did not predict what would happen next, and rejection from the families of victims. Sure enough, that happened.

I did not predict what would happen next, which is that the Secretary of the Defense,

Lloyd Austin, actually withdrew that plea deal. And instead, they will go back to seeking

death penalty on Khalid Sheikh Mohammed. I think it was the right and smart and just decision

by Secretary Austin. I agree with former Attorney General Eric Holder.

I mentioned him last week. He actually tweeted out earlier this week that he believes these

cases should have been moved over to civilian criminal court, to our normal criminal courts

all along. That was briefly the plan, but then it was abandoned for political reasons.
