Attorneys independent of the Delphi criminal case filed a petition with the Indiana Supreme Court against Special Judge Francis Gull from Allen County for a writ

of mandamus and prohibition.

That's a legal term that asked for the High Court to order a lower court to follow the rules

or correct mistakes.

The petition argues court records sealed in this case should be made public.

The state's highest court has set a November 9th

deadline for interested parties to weigh in. On Tuesday, Judge Gull refused to let Andrew

Baldwin and Bradley Rosie continue as Richard Allen's attorneys. She said they engaged in gross

negligence. They said that's the court's opinion. I spoke with longtime defense attorney

Ben Jaffe. There hasn't been a clear showing that there is some gross negligence. And even if there

was, does it warrant the removal or does that give the court an actual authority to remove them?

Those are still unanswered questions.

A hearing is happening right now for Brian Coburger. The man accused of stabbing four University

of Idaho students to death last November. Coburger's lawyers now want to know exactly how

investigators were able to gather Coburger's DNA that they say placed him at the scene of the crime.

Investigators used a process called investigative genetic genealogy or IG to collect DNA

from another source and ultimately match it to the DNA on a knife sheath found at the crime

scene near the bodies of two of the victims, Kaylee Gonzalez and Madison Mogan.

This DNA match is possibly the prosecutor's strongest piece of

evidence against Koeberger.
