Okay, the Daniel Penny jury is deadlock, David.

Yes, Daniel Penny, the retired retired marine who was also a college student

who subdued jordan neely on a subway after jordan neely was going on a

homicidal rant and scaring a bunch of people uh daniel penny put him in a chokehold to subdue him

and then uh jordan neely wound up dying he had a pulse when the cops got there by by the way. That needs to be repeated, I think, every time you sort of reset this story. Right. Because there's a lot of people who assume he choked him out to death right then and there on the floor of the subway train. That's not what happened. No. Well, he's on trial, and the most serious charge is second-degree manslaughter.

And without that, you can't convict him of negligent or criminal negligent homicide either.

And the jury has been deliberating since Tuesday.

They send a note to the judge this morning saying that they are deadlocked.

And so the judge is going to be conferring with opposing counsels.

And they are going to probably the judge is going to say try a little bit longer.

So it's not a hung jury just yet.

But, you know, this is kind of the best case scenario shaping up for Daniel Penny.
