Welcome back to the Dershow.

Today, Justice Clarence Thomas issued a temporary stay

at the emphasize that it's temporary against a grand jury,

compelling Senator Lindsey Graham to testify about calls that he may have

made to authorities in Georgia regarding counting the vote

and other things relating to the election.

Senator Graham claims that he has the right not to be questioned about these

and other issues because of his role as the United States Senator

and he invokes Section 6 of Article 1 of the Constitution.

So let me read you that and then we'll discuss

whether it applies and whether Senator Graham is likely to

be able to turn this day from a temporary one into a permanent one.

So the Constitution says that members of the Senate and representatives

shall in all cases accept treason and we're not involved with that now felony

or breach of the piece be privileged from arrest during their attendance

at the session of the respective houses. That seems clear while they're in

the house itself or in going and returning from the same.

That is on the trip back and forth. I think it was Congressman Kennedy

who was arrested on the way to Congress or a way out of Congress

for I don't remember drinking there perhaps and that issue arose in that case.

And then here's the critical language and for any speech or debate

in either house they shall not be questioned in any other place.
