Apple appears to be drawing a bit of regulatory scrutiny in Europe.

The Financial Times says the European Commission is looking into charges that the Kubertino company is forcing rival smartphone makers out of the European market

with anti-competitive iPhone sales tactics and technical restrictions on the handset, according to the piece.

The focus of the inquiry seems to be on the distribution terms demanded by Apple and whether

they favor the company by ensuring that no rival can get a better sales deal.

Quoting the report, the nine-page questionnaire sent to telecoms groups

primarily relates to sales practices,

including whether Apple forces groups to buy a

minimum number of iPhones, restrictions on the use of marketing budgets, and

clauses that ensure Apple is always offered no worse subsidies and sales terms than other smartphone makers.

It also asks whether Apple places technical or contractual restrictions on the iPhone 5 that

mean it cannot be used on high speed 4G networks in Europe.

Why would Apple want to keep iPhone 5 off of 4G networks. Interestingly, Apple saving Grace in the EU may be Samsung.
