You may have said something that you don't have a factual foundation for.

And I think I have done my best to disabuse the court of that, that we were drawing from

reasonable inferences.

I wonder if the Commonwealth is going to get the same treatment for saying that Trooper

Proctor was standing feet away from the defendant's vehicle and never touched the right rear

tail light.

That's a very bold statement for the Commonwealth to make, and it's also completely untrue. It's not supported by a

single fact. It's not supported by a fact or evidence before the court. The problem with this

unsupported motion, because it's unsupported, and the declaration is signed by three different

individuals, you can just sort of say whatever you want in the motion.

And I guess get away with it.

It shows Michael Proctor walk behind the car directly to the position of the passenger tail light.

He positions himself right on the other side of the camera view, not feet away, and it certainly

does not show and there's no evidence before the court that he quote, never touched

it.
