John, this is going to be an unmitigated disaster.

I want to welcome everybody who is here with us in person for this law talk taping at the Federalist

Society's annual meeting. And I want to thank all the people who are listening at home in our normal format.

You're going to have to bear with us if you're listening at home because we have an audience in

front of us of people who are deeply versed in the kinds of issues that you guys talk about.

And we have an audience at home that may not be quite as deep in these things.

But I believe that in the best law talk

tradition, we will find a way to disappoint both of those contingents tonight.

For those of you who don't know me, my name is Troy Seneca. I'm a former presidential

speechwriter and the co-founder of Kite and Key Media. And for the past, over a decade,

I have had the pleasure to have regular

sessions with these two gentlemen on gentlemen on topics in constitutional law, usually the pleasure,

sometimes the dishonor. And it just remains for me then to introduce them to you, as if you

didn't already know, Richard Epstein, the Peter and Kirsten Bedford

Senior Fellow at the Hoover Institution, the Lawrence A. Tish Professor of Law at NYU, and senior

lecturer at the University of Chicago, and John Yu, visiting fellow at the Hoover Institution,

the Emmanuel S. Heller Professor of Law at the University of California, Berkeley, and former Deputy Assistant Attorney General in the Bush administration of the unionists.

I still have to read that after 12 years. I've never memorized this.

It's because it changes every episode.

So, gentlemen, welcome. Thank you both for being here. I want everybody in the audience to know

how close run a thing this was.

I wasn't sure that we were going to be able to pull this off.
