Well, howdy there internet people, let's go again. So today we are going to talk about

Washington State and a native win over a railroad.

And this is something that has been ongoing

for quite some time, but a resolution has arrived and it is quite the resolution so we are going to go

over it. All right so so to set the scene, in Washington State you have the Swinemish tribe.

Back in 1991, they reached an agreement for an easement, for a railroad.

The agreement allowed 25 cars to go each way each day.

Pretty simple.

The tribe, they had a very vested interest in being very careful with this when it came to the

waterways, the fish habitats, stuff like that, because those fish

habitats are central to their way of life.

So they wanted to protect them obviously. Now in 2015 they filed suit.

2015 almost a decade ago.

Now, the judge has issued the order,

and it found that BNSF had deliberately violated that agreement. And it basically seems like it boiled down to trespassing. And they

looked at from 2012 to 2021 where those years came, I'm not really sure. I'm not sure why those

were the cutoff dates. But they looked at that time frame to determine how much BNSF railways should pay the tribe.

Four hundred million dollars. $400 million.

That is a lot of money.

It is worth noting that the Swinamish, I want to say they have somewhere

between 1400 and 1500 people.
