| 1:16.8 | When you file to register a trademark, there's a period where the board allows for people to challenge the registration with what is called a trademark opposition. |
| 1:27.8 | So sometimes the board themselves, the trademark trial and appeal board will look into the application and see if there's anything that's too confusing or similar to the trademark and they themselves will deny it because of consumer confusion. |
| 1:42.8 | Other times, people that have trademarks that think that this one might encroach on their mark can file what it called a trademark opposition, which is what Slim Shady here filed. |
| 1:54.8 | And this happens all the time. This is not some weird situation where Slim Shady is being shady. I mean, he himself has filed many trademark oppositions. |
| 2:05.8 | And it's just for you to try and protect your mark. Think back to our Vineyard Vines episode. |
| 2:12.8 | This is similar to what Vineyard Vines did against Margaret Joseph's when they were trying to just protect their mark. It happens. |
| 2:20.8 | The way I like to see it is if, I don't know, I don't know why when I think of this period in trademark, I think of some old timey guy with a newspaper out in a square and he's like, here, here, he. |
| 2:35.8 | Joselle Bryant and Robin Dixon, so do apply for a trademark and reasonably shady. And then someone all stands up and goes, no, no, no, this is too close to the trademark that I have. |
| 2:48.8 | They cannot proceed. That's what I picture. That is how it happens here. It's all done electronically and is really smart for brands to be out there and be checking what is going on in the trademark world. |
| 3:03.8 | It's smart business to make sure that no one else's brands are encroaching or no one else's marks are encroaching on your mark. |
