Summary

Harvard Kennedy School's Julia Minson joins to discuss her new book, How to Disagree Better, and why the goal of most arguments shouldn't be persuasion at all. She explains naive realism, the boomerang question trap, and why understanding where someone is coming from beats trying to change their mind. Plus, Anthropic wins in court and the Prairieland antifa trial ends in across-the-board terrorism convictions, a reminder that when the stakes are so high outrage is not a legal strategy. It's Thursday, March 27th, 2026 from Peach Fish Productions.

It's the gist.

0:08.3

I'm Mike Pescott.

0:09.6

And a U.S. district judge, Rita Lynn, on Thursday, ruled in favor of Anthropic, which had

0:14.7

sued the Pentagon in their attempt to designate them a supply chain risk because the Pentagon

0:20.5

was trying to punish Anthropic

0:22.6

for not building all the weapon systems.

0:24.7

It wanted the judge called the administration's moves Orwellian, somewhere Orwell's

0:29.3

saying, I was a wordsmith.

0:30.4

You should come up with some better adjectives.

0:32.7

The judge also said at bottom, Anthropic has shown that these broad punitive measures were

0:37.4

likely unlawful

0:38.6

and that it's suffering irreparable harm from them. You know why the judge made that ruling?

0:44.1

Well, because the Pentagon just did a knee-jerk action which never really intended to satisfy

0:51.1

the law. But on a simpler level, what Anthropic did was they argued in court,

0:58.2

they presented a case, they saw a laughable ruling, and did more than laugh at it. Now I should

1:05.1

disclose that Anthropic is a sponsor of the gist. You hear the ads for Claude on the gist. I don't

1:10.0

think that at all influences what I think of Anthropic. I was just thinking of them as a responsible

1:14.9

company with a lot at stake who brings to the table all they can to argue their case.

1:20.6

Let us now contrast that to the concluded trial in Prairieland, Texas, which after a day

1:27.3

and a half of testimony, the defendants

1:29.7

weren't found guilty of all charges, but all were found guilty of serious charges, and
