Summary

The jury has been selected in a New York courtroom to judge the guilt or innocence of a former president of the United States. This is an important step in the direction of fulfilling the long-dormant American promise that no one is above the law. Glenn does a deep dive into several jury issues, including Judge Juan Merchan's unusual process of letting jurors self-identify as unable to be fair and dismissing them with no follow-up questions. And Glenn discusses the fact that two of the jurors are attorneys. He says this is a good thing because attorneys know the law and they can be a big asset in making sure all jurists listen to the facts and follow the judges instructions.

It's time for Justice Matters with former federal prosecutor and MS NBC analyst Glenn Kirchner. The jury has been selected in Donald Trump's first criminal trial in New York.

0:20.0

Here's Glenn with an update.

0:22.0

So friends, jury selection in Donald Trump's first criminal trial, the first of four, is moving along at a pretty good clip. Now you may have heard that Judge

0:35.0

Mersham, the presiding judge, is going to sit in trial on Mondays and Tuesdays and

0:39.8

Thursdays and Fridays. So that means on Wednesdays we're going to do a deep dive.

0:45.7

You know, we're going to take a breath and we're going to try to talk about what's gone on

0:50.4

on Monday and Tuesday. What we project might go on on Thursday and Friday, and we will

0:57.4

take on a legal issue that has perhaps bubbled up that we haven't really had time to do a deep dive into. So today I want to take

1:07.7

on three questions concerning jury selection. First is a question that I have been asked several times in recent days and

1:16.2

that is how is it that when Judge Mersharn brought the first 96 jurors in he asked them one question who here thinks they can't be fair

1:26.0

something like 50 hands went up and those people were excused they weren't asked any follow-up questions. Is that

1:35.8

usual? Is that the way juries are ordinarily selected? The answer is no. It's

1:40.6

not usual. It's unorthodox unorthodox in fact for this 30 year prosecutor it's

1:46.2

unprecedented I've never seen jury selection start like that we're going to talk

1:50.8

about why that is the second thing I want to take on is who are these jurors who have been qualified?

1:58.0

Where do they come from? What do they do and what does it kind of portend moving forward? What might this jury look like?

2:07.0

And then friends, the last issue I want to take up is whether prosecutors and criminal defense attorneys like to have lawyers as jurors.

2:18.0

And the answer to this one may surprise you. The reason we're going to talk about this and do a little bit of a deep dive

2:25.2

into that topic is because two of the jurors who have thus far been qualified are our lawyers.

2:33.8

But first, let's take up the jury selection process

2:37.6

and how it was really unusual.

2:40.4

So what Judge Mershaun decided to do was bring the 96 jurors, that's Wave 1, they will be coming in in waves.
